These SMS Terms and Conditions (“SMS Terms”) govern the text message programs operated by SMILE-FX® : Orthodontic & Clear Aligner Studio (“SMILE-FX®,” “we,” “us,” or “our”). By enrolling in a SMILE-FX® text message program, you agree to these SMS Terms.
Our text message programs
SMILE-FX® operates two separate text message programs. They are independent of one another. Enrolling in one does not enroll you in the other, and you may enroll in either, both, or neither.
SMILE-FX® Appointment & Account Messages
This program sends messages about your care and your account with our practice. It includes the following types of SMS communications:
- Appointment reminders
- Account updates
- Appointment confirmations, scheduling changes, and cancellations
- Replies from our team to a question you sent us
- Billing and payment notices relating to your account
SMILE-FX® Offers & News
This program is marketing. It includes the following types of SMS communications:
- Promotional offers
- Practice news, events, and new service announcements
How you enroll, and how consent works
You enroll by checking the checkbox for that specific program on a SMILE-FX® web form, by signing a SMILE-FX® paper or electronic form that contains the same disclosures, or by texting a keyword we publish to our number. Each program has its own checkbox. No checkbox is checked in advance, and you must check it yourself for consent to be given.
Consent to receive text messages is not a condition of purchase. You are not required to agree to receive any text message from SMILE-FX® in order to book an appointment, become a patient, receive treatment, buy any product or service, or use any part of our website. You may decline either program, or both, and still complete any form and
receive care on the same terms.
You may only enroll a mobile number that belongs to you or that you are authorized to enroll. You must be 18 years of age or older, or the parent or legal guardian enrolling on behalf of a minor patient. Our text message programs are available on U.S. mobile numbers only.
Message frequency
Message frequency varies.
For SMILE-FX® Appointment & Account Messages, frequency varies with your appointments and account activity. For SMILE-FX® Offers & News, frequency varies with our promotions and practice news.
Cost
Message and data rates may apply. Contact your carrier for details.
SMILE-FX® does not charge you for these messages.
How to stop messages
To opt-out, text “STOP.” You will receive no further SMS communications.
Replying STOP to a SMILE-FX® number stops all text messages from that number, including both programs. You will receive one final message confirming that you have been unsubscribed. If you want to stop marketing messages but keep receiving appointment and account messages, call us at (954) 824-9707 or email [email protected] and tell us which program to remove you from. Opting out of text messages does not remove you as a patient and does not affect your care.
To rejoin after opting out, check the checkbox again on a SMILE-FX® form, or contact us and ask to be re-enrolled.

Your information
Your information will not be shared with third parties for marketing purposes.
We will never share, trade, or otherwise sell your personal information such as phone numbers and SMS consent to third parties under any circumstances.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.
The messaging provider that transmits these messages acts only as our service provider, delivers messages on our behalf, and is contractually prohibited from using your mobile number or your SMS consent for its own purposes. This is not a sale, rental, transfer, or sharing of your information.
We may also disclose information where we are legally required to do so, such as in response to a valid subpoena, court order, or other lawful request.

Supported carriers and carrier liability
Our text message programs are supported on most major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Not for emergencies
Do not use text messaging to report a dental or medical emergency. If you have an emergency, call 911 or go to the nearest emergency room. For an urgent orthodontic problem, call our office at (954) 824-9707.
Changes to these SMS Terms
We may update these SMS Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Continuing to receive our messages after an update means you accept the updated SMS Terms.
