SMILE-FX Paid Media Operator Terms of Use

These Terms of Use govern access to and use of the SMILE-FX Paid Media Operator, an internal administrative application operated under the SMILE-FX Orthodontic & Clear Aligner Studio business name at 11225 Miramar Parkway, Suite 285, Miramar, Florida 33025. In these Terms, “SMILE-FX” means the business operating the application.
1. Internal authorized use only
The Paid Media Operator is not a public, patient, or consumer application. It may be used only by SMILE-FX personnel, contractors, and service identities that SMILE-FX has expressly authorized and assigned an appropriate app, business, ad-account, Page, or other asset role. There is no public signup or patient login.
2. Permitted purpose
Authorized operators may use the application only to support SMILE-FX’s own advertising and related business operations. The currently implemented operator workflow retrieves bounded advertising and authorized business-asset configuration, reviews delivery and performance information, performs operator-led documented diagnostics, and prepares exact proposed campaign changes. An approved change may be executed through Meta’s official surface only after action-specific authorization has been obtained through the designated approval process.
The application may access only assets owned by SMILE-FX or assets for which the owner has expressly granted SMILE-FX the necessary role and authority. Access to an asset, acceptance of these Terms, assignment of an app role, or possession of credentials never authorizes a live mutation. Approval must identify the specific proposed budget, bid, targeting, conversion, status, campaign, ad, creative, Page, catalog, message, lead, content, publication, or bounded batch action.
3. Prohibited conduct
An operator must not:
- access or attempt to access an account, Page, profile, catalog, message, lead, or business asset without authorization;
- share credentials, access tokens, app secrets, or system-user credentials;
- bypass approval, least-privilege, rate-limit, audit, security, or platform controls;
- use Platform Data for surveillance, discrimination, eligibility decisions, sale, unauthorized profiling, or any purpose unrelated to the approved SMILE-FX business workflow;
- intentionally submit or route patient clinical records, protected health information, payment-card data, credentials, access tokens, app secrets, sensitive identity documents, or other sensitive data into the application;
- reverse engineer, disrupt, overload, circumvent, automatically collect, or scrape Meta services or content except where the activity is expressly authorized by the applicable Meta terms or Meta’s written permission.
If sensitive content is inadvertently received, it must not be used for clinical care or ad targeting. Access must be restricted, the incident must be escalated through the documented security or privacy process, and eligible copies must be deleted under the published Data Deletion Instructions.
4. Access, security, and operator responsibility
Operators must use their assigned identity, protect authentication material, use only approved devices and workflows, and promptly report suspected unauthorized access or disclosure. Operators are responsible for confirming the correct business, account, Page, campaign, and action before approving a change. SMILE-FX may restrict, suspend, rotate, or revoke access at any time to protect the application, its assets, or connected providers.
5. Operational changes and approvals
Reporting, diagnostics, and staged drafts may be performed within assigned access. Any live budget, bid, targeting, conversion, status, campaign, ad, creative, Page, catalog, message, lead, content, or publication change requires action-specific approval through the designated approval process. Operators must preserve required review evidence and must not represent a staged, test, pending, or provider-delayed result as complete.
6. Platform Data and privacy
Platform Data is used only for authorized authentication, asset discovery, advertising reporting, diagnostics, controlled operations, security, and compliance. Access is limited to authorized personnel and service identities. SMILE-FX does not sell Platform Data through this application.
The current Marketing API workflow primarily uses business and administrative information, such as operator authorization, business and advertising identifiers, Page metadata used in an advertising workflow, campaign configuration, performance metrics, security records, and temporary caches or exports. If another Meta business workflow is enabled and actually used, additional data categories are limited to what that workflow requires.

7. Third-party platforms
The application connects to services operated by Meta and may use other approved infrastructure providers. Use of Meta services is also governed by the Meta Platform Terms, Meta Commercial Terms, applicable Meta Business Tools Terms, Meta Advertising Standards, and product-specific terms and policies. If these internal Terms conflict with an applicable Meta requirement, the stricter Meta requirement controls. SMILE-FX does not control provider outages, approval timing, counter propagation, API changes, or provider-hosted source data.
8. Records and retention
SMILE-FX may retain security, authorization, operational, and compliance records necessary to protect the application, document approved actions, resolve disputes, and meet legal or accounting obligations. Retention is limited to the applicable purpose and schedule. Eligible personal data deletion is handled under the published Data Deletion Instructions.
9. Intellectual property
SMILE-FX or its licensors own only the SMILE-FX-created software, configurations, workflows, documentation, branding, and permitted derivative operational records. Nothing in these Terms claims ownership of Meta Platform Data, Meta interfaces, third-party content, or an asset owned by another person or business. These Terms grant only a limited, revocable right to use the application for authorized internal work and grant no public distribution right.
10. Availability and internal-use disclaimer
The application is provided for authorized internal operations and may be changed, limited, or unavailable during maintenance, provider changes, security events, or review. Operators remain responsible for validating material decisions and provider-confirmed results. Nothing in the application replaces legal, privacy, security, clinical, or accounting review where that review is required. Nothing in this internal-use disclaimer waives or limits any security, privacy, confidentiality, deletion, incident-response, or Meta Platform obligation.
11. Suspension and termination
Access ends immediately when authorization is withdrawn, a role ends, credentials are compromised, use violates these Terms, or SMILE-FX determines that suspension is needed for security or compliance. On termination, the operator must stop using the application and return or delete SMILE-FX-controlled credentials or exports as directed.
12. Changes to these Terms
SMILE-FX may update these Terms to reflect application, legal, security, or provider changes. The version and effective date above identify the current Terms. Continued use after an update is limited to operators who remain authorized and comply with the updated Terms.
13. Governing law and contact
These Terms are governed by applicable United States federal law and the laws of the State of Florida, without regard to conflict-of-law principles, except where non-waivable privacy, consumer, employment, or other statutory rights apply.
